Ethics Communication Channel

HIDROTEN S.A. provides an Ethics Communication Channel for interested parties, in compliance with and under the protection of Law 2/2023, for the submission of information related to:

  • Actions or omissions that may constitute a criminal offense or a serious or very serious administrative violation.
  • Actions or omissions that may represent violations of European Union law, as stated in Article 2.1.a) of the Law.
  • Violations of labor law regarding occupational health and safety.

The channel is also available to report any breach of current legal regulations, as well as to submit questions, complaints, or suggestions related to Compliance.

Communications will be received and handled by members of the body responsible for the channel (Compliance Body – Compliance Officer Role) and by the Governing Body of HIDROTEN S.A.

If you believe that any of the individuals who would normally receive your report (the Responsible Body of the Channel or the Governing Body) is involved in the matter being reported, you may block the communication to that body, thereby excluding them from the processing and investigation.

HIDROTEN S.A. strictly prohibits any acts of retaliation, including threats or attempts of retaliation, against individuals who submit a report in accordance with the law.

Maximum confidentiality and anonymity are guaranteed during the investigation process. All reports are treated with objectivity, impartiality, and transparency, in accordance with data protection regulations and in compliance with Law 2/2023 of February 20 on the protection of whistleblowers and the fight against corruption, as well as Directive (EU) 2019/1937 of the European Parliament and the Council of October 23, 2019.

The identity of the whistleblower will always remain confidential and will not be disclosed to those referred to in the report or to unauthorized third parties.

When completing the forms, please follow these rules:

  • The information provided must be truthful.
  • Communications must be submitted in good faith.
  • Do not share personal data of third parties who are not involved in the reported incident.
  • Do not include special category personal data (such as health, ideology, union membership, religion, sexual orientation, beliefs, racial or ethnic origin, etc., art. 9 LOPDGDD).

Any individual who, in bad faith, submits a clearly unfounded or malicious report with the intention of causing unjust harm may be subject to appropriate measures or referred to the relevant authorities for possible legal proceedings.

Once the appropriate form has been completed, ÉticoAldía will generate an acknowledgment of receipt, which can be printed or saved as a PDF.

Reports may also be submitted externally through official information channels to the competent authorities or, if applicable, institutions or bodies of the European Union.

These channels include:

  • Independent Authority for Whistleblower Protection (A.A.I.)
  • Corresponding regional authorities or bodies.
  • Public Prosecutor’s Office.
  • European Public Prosecutor’s Office (in cases affecting the EU’s financial interests).
  • National Law Enforcement Agencies.
  • Competent Anti-Fraud Agency.
  • Other relevant entities.
